The Legality Behind Paparazzi Pics

TMZ’s a guilty pleasure for many American’s wanting to know what’s going on in the world of celebrities. But for others it wasn’t that long ago that they would remember news reports from the UK about Princess Diana’s death, and how her life was tragically cut short because of the paparazzi’s need for a picture. Therein lies the tension between photog’s clamoring for the juicy picture they know the world will want to see, and the famous people who have their privacy invaded, and lives severely disrupted.

Who’s the Victim?

Over the last few years there has been buzz about celebrity’s that have sued magazines, and paparazzi who in turn sued celebrities. A recent New York Times article is a reminder of one of the world’s largest multimedia conglomerates, News of the World, and their phone hacking scandal that reached both sides of the pond, affecting celebrities in Britain as well as the US. But the paparazzi have had their share of unfair treatment as well. So who is really the victim here?

Mike Tyson TKO’ed

A 2010 PopEater article talks about Mike Tyson getting sued by a paparazzi photographer for $25 million. According to the report, an altercation at LAX resulted in the photographer receiving injuries to:

• His face.
• Spine.
• Neck.
• Brain.

The Huffington post points out that Tyson alleged the paparazzi photographer, Antonio Echevarria, “aggressively pursed” him and his family through the airport. However, there were no physical injuries or marks on Tyson, and Tyson had been quoted as threatening to kill Echevarria.

Sean Penn’s Paparazzi Vandalism

TMZ reported about Sean Penn’s “no contest plea” to a 2010 incident in which Penn kicked a photographer, who filed a civil lawsuit alleging a knee injury. It settled a little over a year later with an undisclosed monetary amount and Penn facing:

• 36 Months of probation.
• 300 Hours of mandatory community service.

Celebrities Who Have Been Injured

Part of the reason celebrities fight back isn’t just because their privacy is being assaulted, but often so isn’t their safety. Nicole Richie had to be taken to a hospital after a 2009 car accident that was caused when paparazzi following her rear-ended the car she was in. Brad Pitt was rear-ended by a photographer trying to snap his picture while he was riding a motorcycle. Other celebrities that have runs in with the paparazzi include:

• Madonna getting knocked in the face while carrying her baby.
• Jessica Simpson and her friend got smacked in the face.
• Rihanna knocked by a London photog.

What’s the Law?

Although celebrities are affected wherever they go, California is a definite hot spot for celeb-paparazzi battles. In 2009, celebrity, Governor Schwarzenegger offered legal help to his Hollywood pals by passing an anti-paparazzi law. What does this mean?

• Photos and their earnings may have to be forfeited.
• Fines for cameramen.
• Lawsuits for media outlets that publish illegal photos.

The battle between the famous and those who take their picture will not be going away anytime soon. And with increased injuries, and even deaths the likelihood is that there will be an increase in legislation as well.

Celebrities to Keep an Eye on

Every year is an exciting one within the Entertainment world. Figuring out who you should be watching and keeping track of can be difficult. Here are some of the most exciting celebrities to keep your eye on in 2013.

Jennifer Aniston

Even if you’re “Team Jolie” Anniston is someone to keep an eye on. There are few actresses who can pull of smart, edgy and be the charming girl next door type all at the same time. Anniston is one of them. Over the last few years she’s gone from supporting actress to lead actress and has since added the titles of Director and Producer to her resume. She was given a star on the Walk of Fame in 2012 and has a number of projects in the queue for 2013. Maybe this year she’ll find her “Blind Side.”

Ed Sheeran

He may only be 22, but Ed Sheeran is definitely making a name for himself in the music scene. He started out as an independent musician playing gigs almost every day until his indie album caught the attention Asylum/Atlantic Records. Now he’s signed with the label and was named The British Breakthrough Artist of the Year in 2012. He’s a great inspiration for people in the indie scene who have dreams of going mainstream.

Kim Kardashian

Yes, we know that she’s Kanye’s Baby Mama but we’re hoping that beyond watching her adjust to new motherhood 2013 will be the year we finally figure out why, exactly, she’s famous.

Louis CK

His sitcom has been wildly successful for several seasons; he’s won Emmys and has one of the most successful comedy specials of all time (thanks to his selling it independently). With his sitcom, Louie, on hiatus this season nobody is quite sure what he has up his sleeve for 2013 but we’re willing to bet that it is going to be phenomenal.

Katie Holmes

She’s finally free of Tom Cruise and hopefully that means she can start taking on film and television projects again. We’re hoping that her career really takes off now that the two have split. It happened for Nicole Kidman, Penelope Cruz and Mimi Rogers (all former or near-former Mrs. Cruises), there’s no reason to believe it won’t happen for the most memorable cast member of Dawson’s Creek. We can’t wait to see what projects she takes on this year!

Justin Timberlake

The mega pop-star took his turn in a Clint Eastwood vehicle in 2012 and has more in store for 2013. In addition to the traditional entertainment projects, Timberlake is also spearheading the MySpace revival effort. The site is due to reopen hopefully soon and if Timberlake can bring it back to life he’ll be able to add “Internet Mogul” to his resume which will make him a…quadruple threat? We’ve lost track of how many threats he is.

Justin Bieber

It is easy to get swept up in the trappings of Hollywood glamour. We see celebrities and think, ‘if only I could be them.’ The reality is that being famous isn’t all it’s cracked up to be, and the Hollywood life can be much harder to navigate then people think. The 300 star, Gerard Butler checked himself in the Betty Ford clinic and told US magazine in an interview that he “has a pretty addictive personality” and was becoming addicted to prescription drugs. He had the medication because of injuries he sustained from 3 of his films. But when he realized it was getting out of control he went to get help and become “a mental warrior”.

Kirsten Dunst

In an interview with British Elle Kirsten Dunst talks about her time in rehab at the Cirque Lodge. She said her time there was to deal with depression issues she had been struggling with. Ironically Dunst was able to use these personal experiences for a role in Melancholia which made her “the center of attention at the Cannes Film Festival”.

How Celebrities Stay Sober

Actor Martin Sheen told AARP Magazine that he works the AA program and credits his faith in Catholicism to staying sober for so many years. At one time Robert Downy Jr. could have been the poster child for celebrity addiction but it seems he has finally kicked the habit and he credits plenty of yoga, Kung Fu, and the support of his wife for keeping him straight. The types of methods that celebrities will encounter in these treatment facilities include the 12 step programs, care from medical professionals, private counseling and behavior modification, and other treatment that targets the brain imbalance of the addict.

The Papparazzi: A Day In The Life

There are many kinds of photographers out there: there are nature lovers, wedding photographers, those who work for advertisements; and then there are the paparazzo photographers, the ones who stand out from the crowd. The paparazzi sure have a very interesting life too, just like the people they sprint after all day.

Today, many photographers are choosing the paparazzi over other careers in photography. Formally known as photojournalism, the job of being a paparazzo can have some negative connotations as well.

However, nobody can deny the fact that the world of celebrities is brimming with juice only because the paparazzi exists; how else would anyone manage to get those million-dollar celebrity shots? These people behind the lens surely have an interesting job; they have to chase the rich and famous, and get a shot that will sell.

Good photography colleges churn thousands of potential graduates each year, who venture into various fields of photography based on their interests. Some of these take the challenge of jumping onto the paparazzi bandwagon. The paparazzi hired by a magazine are usually expected to bring in their own equipment; high end cameras, tripods etc. But most expected from a paparazzo are a timely appearance, a perfect angle, and a scandal awaiting to be captured.

So why is it that the paparazzi end up being the media scapegoats? These photographers are despised for barging into private estates, capturing awkward moments, and selling someone’s personal affairs. Ever wondered how much of these allegations are true? The paparazzi are also a form of journalists, who head out to earn their bread and butter; and this is something most of us forget.

Photographers of a paparazzi squad are better off with camera equipment that can capture high definition photographs from a great distance. They also have to keep swapping between long range and short range cameras, based on the situation. Precise timing is required by the paparazzi in order to capture the best celebrity shots.

The job nevertheless is absolutely fascinating and out of the ordinary. Whether Lindsay Lohan has earned another DUI arrest, or Britney Spears has another shameful moment; these people have to be there. There are no specific limits for privacy defined for the paparazzi; why should they be answerable when someone else is embarrassing themselves in public?

Having said that, there are some photographers that break the code; the person who captured Kate Middleton sunbathing with her husband did not do a pleasant job. Peeking into private estates is not a great thing to do, especially when you can be sued by the British Royals.

The paparazzi are also harassed by the celebrities on occasions; these brave soldiers head out into the battlefield with their cameras to not only take pictures, but also to occasionally get attacked by a drunken celebrity.

Being paparazzi doesn’t always mean chasing the troubled A-listers; pictures of celebrities shopping and leaving salons sell equally well.

Celebrity photographer Henry Flores, who has also published a book on his profession, says that being a paparazzo is not an easy job. The industry is inundated with inexperienced and under qualified individuals; maybe it is time that more professional and qualified photographers become part of the paparazzi.
