It’s always a tricky business to declare the death of any company before all the deals are really done, but if it’s final enough for Anne Thompson, I’m loathe to disagree that the studio founded by Harvey and Bob Weinstein and named after their parents, Mira and Max, is winding up on a financial ash-heap.

The Weinsteins are not just any producers and Miramax was not just any company. For good and for ill — not all their movies were great by any means, a few I even hated (don’t get me started on “Chocolate”) — they were and are throwbacks to the moguls of the past. They make decisions in a mercurial, seat of the pants way that always seems to generally produce better material than the cool logic of an MBA, which may be safer but rarely produces the kind of movie that really blows anyone’s mind. You don’t produce a “Pulp Fiction” by thinking like a marketing major, you produce it by thinking like a showman.

As I understand it, Disney wanted a certain amount of cash for the 700 or so titles in the company’s library, and they got it from a construction magnate with apparent close ties to the least trusted and most widely disliked person in an industry with a high quotient of untrustworthy and unlikable people. Disney has done a lot of things right over the years and they’ve done a lot of things wrong, I make no claims to being able to really look inside this as a business decision, but this certainly feels wrong. The film studio that launched some of the greatest behind-the camera talents around, including Quentin Tarantino, Alexander Payne, Jane Campion, Anthony Minghella, Kevin Smith, Steven Soderbergh and even (in the U.S. market) Hiyao Miyazaki, among many others, deserves better.

For more, I definitely suggest you read the Anne Thompson piece I linked to above, and check out her links as well. Wikipedia has a partial and awe-inspiring list of films made and released by the company.

And now, your moment of Miramax.

First of all, my apologies for the pedestrian football metaphor in my headline tonight, but all the good ones have already been taken. Add to that the fact that, with my knowledge of sports, you’re likely to end up with “‘The Blind Side‘ hits a grand slam'” or “‘The Blind Side’ scores a 3-pointer.”

Be that as it may, the up-beat social issue/sports drama starring Sandra Bullock did indeed do extremely well this week. Taking a look at the Box Office Mojo chart, the $29 million film earned a very nice estimated $20.4 million for Warners and Alcon Entertainment in its second weekend and has so far earned a really terrific total amounting to roughly $129,264,00 so far.

As a comparison, my favorite movie of the year (that I’ve seen…I’m way, way behind), “Inglourious Basterds,” was considered quite the success. With a $70 million budget, after 16 weeks it has earned $120,467,000 for Harvey and Bob Weinstein. “2012” cost $200 million to make, a rather obscene sum that was unthinkable not so long ago, and in four weeks in wide release has earned a mere $148,787,000. I haven’t seen “The Blind Side,” but it just makes me happy that a modest movie about people is proving, I think, to be significantly more profitable than at least one pretty obviously bloated spectacle.

As for that other movie about teen vampires, werewolves, and waifs, B.O. Mojo’s Brandon Grey is here to tell us that “The Twilight Saga: New Moon” dropped another 63% this week. However, it’s opening week take was so stunning that meant it still took in a respectable estimated $15.7 million for Summit. It’s total domestic bankroll at this point is about $255.6 million and, as per Variety‘s Pamela McClintock, the worldwide total for “New Moon” is $570.1 so far. All that, with a budget of only about $50 million for a fantasy film. The “Twilight” films might not be seen by anyone as great cinema, but they are pretty awesome business.

For you schadenfreude fanatics, Nikki Finke reminds us that both “The Blind Side” and the “Twilight” franchise were placed into turnaround by Fox and Paramount respectively. However, it’s always possible that those other studios would have found a way to mess up those pictures or their marketing, so who knows how things would have turned out with different studios? In any case, no one wins all the time.

As for the actual new films in wide release this weekend, it’s not too pretty. As expected, the downbeat Afghanistan war-oriented drama, “Brothers,” came in at the #3 spot, but with an unimpressive estimated $9.7 million, though the modest budget ($3 million lower than “The Blind Side”) will help Jim Sheridan’s remake of a Danish hit to perhaps break even in the long run or do a bit better if Oscar notices it. Still, considering the three major, youngish stars, it’s another testament to the apparently declining value of star power. Are people finally getting sophisticated enough about filmmaking that they understand that actors, as crucial as they are, don’t actually make up the stories or point the camera? Nah. It’s gotta be something else.

In this case, I think the film was probably hurt by a dour ad campaign and the wrong kind of timeliness. People who care about what’s going on in Afghanistan, particularly those who have loved ones in the military or are in the military themselves, probably don’t want to spend their leisure/fun time thinking about it right now, and people who don’t care about it…don’t care about it. A little bit more critical buzz might have been nice as well.

As for the other three new releases, it kind of unpleasant, so I’ll start with the good news, which is that the Oscar and critical support building behind “Up in the Air” is paying off. In limited release in 15 theaters, the adult-oriented R-rated comedy from Jason Reitman earned $1.185 million for an airborne per-theater average of $79,000.

Okay, back to the bad news. Nimrod Antal’s PG-13 heist thriller, “Armored,” was sequestered from critics prior to its release, but actually got a could-have-been-worse 44% rating from Rotten Tomatoes. Still, audiences weren’t overly impressed and the film came in #6 and earned an uninspiring $6.6 million for Screen Gems in under 2000 theaters.

“Everybody’s Fine” apparently wasn’t really doing so well. The attempt at a heart-warming family comedy-tearjerker starred Robert De Niro, Drew Barrymore, Kate Beckinsale, and Sam Rockwell, but apparently even grandma wasn’t too interested in this one. It came in at the #10 spot on its opening weekend with only an estimate of a little above $4 million from over 2000 theaters. Again, stars of any age group aren’t really doing it right now.

Not that having no stars is a good thing either. The week’s under-ballyhoed youth-oriented alleged horror-comedy, “Transylmania,” boasted a really dumb name and a trailer so unfunny I dare not link to it a second time lest I bring a rain of destruction upon this blog and all who view it. Eight critics did venture into a theater to review the movie. Of course, they all hated it. Actually, if those eight tickets all went to the same theater, they would have wound being more than a third of the film’s beyond horrific opening weekend per-screen average of $232. It earned a truly sad $274,000 in over 1,000 theaters. By comparison, 1985’s “Translyvania 6-5000” with, among others, Jeff Goldbloom, Ed Begley, Jr., Norman Fell, and Michael Richards was a blockbuster.

I’ve been distracted wrapping up another project, but a few things of note did transpire to cap off this doozy of a week while I was otherwise absorbed.

* Both Variety and Nikki Finke are reporting that Miramax, the once groundbreaking “mini-major” founded and eventually sold by Harvey and Bob Weinstein that was named after their parents, Mira and Max, is being downsized/restructured by Disney. Meanwhile, grinning Disney Channel head Rich Ross is apparently a near-certainty to step into the void left by the departed Mousehouse chair, Dick Cook. I’m not sure why, but I have a funny feeling about this.

* Finke also has word that The Hollywood Reporter (aka THR) may well become a weekly as well as going behind a ‘net “wall.” If so, that’s going to leave a heckuva void for someone to fill online. If Finke has any visions of empire, this could be her moment — but she can’t do that alone. Personally, I’ll miss the video versions of the box office prognostications of the man I call “jolly Carl DiOrio.” He just seems so happy when he talks how well movies are going to do each week.

* THR has details on the 1993 settlement between Roman Polanski and his now adult victim. The odd part is that the records here don’t show whether or not Polanski ever paid it. If he didn’t, the woman is one extra-forgiving lady. I suspect he did.

* I’m not quite a diehard member of his cult, but I’ve always had a soft-spot for director John Carpenter (“The Thing,” “They Live,” “Escape from New York”) since seeing the original “Assault on Precinct 13” — a clever combination of Howard Hawks “Rio Bravo” and George Romero’s “Night of the Living Dead” with gang members replacing frontier desperadoes and zombies. His latest project, reportedly called “Riot” deals with another relic of my childhood, Arnold Shapiro’s “Scared Straight.” I’ll never forget how shocked I was to hear F-words coming from my TV set. Who knew that one day cable TV would make that a near daily occurrence.

Now, I was the kind of kid who freaked out if a teacher even looked at me in a cross fashion. Nevertheless, it definitely worked on me as I’m here to tell you that I’m pretty sure I’ve never committed a felony, even by accident, though it’s always possible I’ve forgotten something. On the other hand, my parking ticket past is thoroughly checkered.

Anyhow, the latest news on the project via Krystal Clark at ScreenCrave is that Nicolas Cage, who was at one point attached, has likely left the project and the same may also go for Carpenter. Could’ve been fun, I guess.

And now a moment of vintage Carpenter.

It’s an odd duck of a weekend coming up, movie-wise. Our new releases include two films seeking to squeeze just a few more dollars from some long-running horror franchises and a historical prestige comedy which isn’t generating a huge amount of prestige.

Though it’s not quite a given, the prognosticators assume that one of the horror franchises — neither of which has been screened for critics — will top the weekend box office. I think you’d have to give the edge to Warner/New Line’s “The Final Destination,” mainly because it’s in 3-D. The format may gin up interest in the fifth installment of the nearly decade old series highlighting elaborately gruesome deaths and definitely will gin up ticket prices at the nearly 1,700 venues showing it in that format. The other horror flick, The Weinstein Company’s “Halloween II,” is not only a sequel, but a sequel to a reboot/remake. The cachet of director Rob Zombie has probably helped give this thing some steam and apparently both horror films are doing the “tracking” thing well, says THR‘s Carl DiOrio. Still, splitting the fright ticket here seems almost inevitable as the films appeal to largely the same audience.

The numbers being bandied about for both films seem to top out at no higher than $20 million or so, with significantly lower amounts for one or both likely. Of course, that mean’s it’s far from impossible that neither film will win the weekend, and Quentin Tarantino‘s verifiable hit “Inglourious Basterds” might just walk away with its second #1 slot to go with its strong weekday performance. Of course, with Hollywood concerned for the fate of Harvey and Bob Weinstein’s new company, the performance of both the Tarantino and Zombie productions will be very closely scrutinized.

Likely to come in fourth place is something completely different. Ang Lee’s “Taking Woodstock,” a fact-based comedy about the young entrepreneur who found himself inside a musical/historical whirlwind when he set up the epoch-making music festival at Max Yasgur’s farm. Though Lee is thought of as a rather heavy-duty director these days in the wake of “Brokeback Mountain,” humor has always been a strong suit going back to his early Taiwan-centric international hits, “The Wedding Banquet” and “Eat Drink Man Woman” (which had nothing to do with cannibalism). Even the downbeat “The Ice Storm” is far more darkly funny that it’s usually given credit for.

That, however, was then. Our own David Medsker apparently reflects critics as a whole in his split decision on the film, and that doesn’t bode well because this isn’t a teenager-centric horror flick. Movies appealing to boomers are helped by good reviews; movies by arthouse-fave directors like Lee need good reviews; movie starring culty stand-ups like Demetri Martin in their first starring role might benefit from good reviews, too. So, a meh-by-definition 51% Rotten Tomatoes rating doesn’t really cut it and I will expect this one to do moderate business at best once the general apathy sets in. Still, that might be ameliorated somewhat by the ongoing interest in all things baby-boomer and to a lesser extent by the absurdly young looking Demetri Martin’s cable TV fame. (Martin, by the way, is 36, despite having a near identical hairstyle to me at age 12. Funny guy, however.) The presence of Emile Hersch, Liev Schreiber, and Eugene Levy in the Greco-Jewish dominated cast might not hurt, either. At least it gives violence-averse aging hippies and ultra-PC liberals (and I’ve known a few) some appropriate entertainment.

That pretty much covers the new releases. However, film geeks in L.A. and New York will have the chance to see a frequently hilarious nightmare version of a sports geek via the acclaimed tragicomedy, “Big Fan,” from Robert Siegel, the very talented writer of “The Wrestler.” Our sports-loving compatriot Mike Farley digs it, and I very much admired it, in a bummed out sort of way, as well when I saw it at the Los Angeles Film Festival several weeks back. The mass of critics agree, too. Patton Oswalt might not look much like Robert DeNiro did during his “Taxi Driver” days, but in every other way, he gives Bobby D. a run for his money.

There are actually four new major releases coming out this weekend, but only one you’ll likely be hearing much about…and you’ve already been hearing about it, and hearing about it, and hearing about it, and we (mostly me) here at Premium Hollywood have been as guilty as anyone.

Quentin Tarantino’s “Inglourious Basterds” is set to make upwards of $25 million says jolly Carl DiOrio of THR and The Wrap’s Lucas Shaw. Those of you who have been following this know that the film’s take has been given more attention than a lot of movies because many suspect it will be crucial to the fortunes of Harvey and Bob Weinstein, formerly of Miramax and now of The Weinstein Company. (They say that they’re actually doing okay.) Harvey Weinstein is such a well known character that all the makers of “Entourage” had to do was hire similarly proportioned character actor Maury Chaykin and call him “Harvey” and 1/3 of the audience probably knew who was referenced. The Weinsteins have always been something of a throwback to the movie moguls of old times with their seat of the pants judgments and risk taking, so that lends a bit drama to the matter.

As for the critical reception, it’s about as good as Tarantino and the Weinsteins could have asked for, especially given that the film’s Cannes premier was greeted with a chorus that some have described as negative but was really all over the place; some proclaimed instant love, others expressed varying degrees of disappointment, and others were baffled. Now, after some apparently very effective tinkering on Tarantino’s part, the U.S. chorus at is singing mostly in harmony with an 88% “Fresh” at Rotten Tomatoes. Though there has been a smattering of controversy over the film’s “once upon a time in Nazi occupied France” tone/plot no-longer-surprises, it’s a far cry even from the debates over violence that raged over “Kill Bill, Volume 1.” Oh well, one less source of free publicity.

There is an additional lure this time. For once, Tarantino isn’t reviving the career of his lead actor but is actually benefiting from the presence of an A-lister in no particular need of a comeback in Brad Pitt. The possible fly in the ointment is that we critics are different from other people: we see more films. No director on the planet so makes movies for movie fans as Tarantino and, as with his other films, there’s always the chance that viewers who aren’t fully steeped in cinema might be lost at sea. As Anne Thompson wrote a couple of weeks back after seeing what she thought was a greatly improved cut of the film:

“Inglourious Basterds” is great fun—for cinephiles. It’s not a mainstream movie. If it gets to $50 million domestic there will be cheers through the corridors of Universal and Weinstein Co. And it should easily do better than that overseas.

That second part of Thompson’s prophesy has already begun to be proven, with Variety‘s Pamela McClintock reporting Tarantino’s strongest opening yet in France, Belgium, and Francophone Switzerland. As for the reaction of regular ol’ Americans, only time will tell. Still, everybody seems to be expecting it to defeat the similarly male-leaning and violent “District 9” and at least match the $25.1 million opening weekend of “Kill Bill, Volume 2.

Carl DiOrio is guessing $8-10 million for the new release from Tarantino’s good pal and “Grindhouse” partner, Robert Rodriguez, who is using the same weekend to put out a film aimed at a completely different audience. Rodgriguez is almost the definition of an uneven director and his last family film, “The Adventures of Shark Boy and Lava Girl” was detested by PH/Bullz-Eye’s David Medsker and earned the eternal enmity of another family man of my acquaintance. (Of course, the hatred is exacerbated by the fact that his kids liked it, forcing him to endure parts of it over and over again.)

The PG-rated comedy, “Shorts,” got a similar 1-star reaction from Medsker but it did slightly better with critics as a whole with an unimpressive 36% RT rating. Still, I’m sure my friend will be hoping this one flies well below his kids’ radar, and he might not be alone. “Shorts” may be booked into nearly as many theaters (3,000+) as “Basterds,” but I doubt RR and QT will be mutually high-fiving each other over similar mega-million receipts on Sunday night.

Booked into just under 2,000 screens, “Post Grad” is a PG-13 comedy starring Alexis Bledel of “Gilmore Girls” and “Sisterhood of the Traveling Pants” about a recent college graduate who returns home to her wacky parents (Michael Keaton and Jane Lynch). It failed to impress our own Jason Zingale and did even worse with critics as a whole, netting a miserable 6% “Fresh” rating. Expectations are very, very modest — perhaps $5 million or so.

The last of the new major releases is a semi-interesting movie anomaly from Disney/ESPN. “X-Games 3-D: The Movie” will on about 1,300 3-D screens for a special one-week only engagement. Unfortunately, critics aren’t seeing anything special here other than an lengthy and expensive advertisement for the popular games and overall expectations here seem nearly as muted. There’s obviously an audience for this sort of thing, but I guess they’ll be too busy seeing the Basterd’s bash their way through alternative history.

Like I’ve been saying, this is Tarantino’s week.
